Terms of Service for Cahoots

Please read these Terms of Service ("Terms") carefully before using Cahoots ("the App"). The App is developed and published by Amun Studios LLC ("Amun Studios," "we," "us," or "our"), a limited liability company organized under the laws of the State of California, United States.

By downloading, installing, or using Cahoots, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

Cahoots is intended for adults. The App contains mature and suggestive themes, and you should be at least 17 years old to use it. By using the App you represent that you meet this age requirement and are legally able to enter into this agreement.

You are responsible for ensuring the App is not accessed by children on your device. If you share a device with a minor, use your device's parental controls or Screen Time restrictions.

You also agree not to use the App where doing so would violate the laws of your jurisdiction.

2. License

Subject to these Terms, Amun Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on devices you own or control, for your own personal, non-commercial entertainment.

You may not:

  • Copy, modify, translate, or create derivative works of the App

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, except where such restriction is prohibited by applicable law

  • Rent, lease, lend, sell, sublicense, or distribute the App

  • Extract, scrape, republish, or commercially reuse the App's prompt library, question content, artwork, or text

  • Remove or obscure any copyright, trademark, or proprietary notice

  • Circumvent, disable, or interfere with advertising, security features, or any technical limitation of the App

  • Use the App for any unlawful purpose or in any way that could damage or impair it

3. The Nature of the Content

Cahoots is a game intended for entertainment only. The questions, prompts, and suggestions it generates are written for fun and are drawn at random from a bundled content library.

3.1 Voluntary participation

Nothing the App displays is an instruction, a requirement, or advice. Every prompt and suggestion is entirely optional. You and any other player may skip, refuse, or ignore any prompt at any time, for any reason or no reason. Declining to answer is always a valid response.

3.2 Consent between players

Cahoots is designed for two consenting adults who choose to play together. You are solely responsible for ensuring that everyone playing has freely agreed to participate, understands the selected spice level, and is comfortable with the content. Consent can be withdrawn at any point by either player. Do not use the App to pressure, coerce, embarrass, or manipulate another person.

3.3 Personal disclosure

Several game modes invite players to share personal information, opinions, or experiences. What you choose to disclose is your decision alone, and you should consider carefully what you are comfortable sharing. Amun Studios is not responsible for any embarrassment, emotional distress, relationship consequence, or other harm arising from information you or another player chooses to reveal while playing.

3.4 Not professional advice

Cahoots is not a relationship counseling tool, a therapeutic product, a compatibility assessment, or a substitute for professional advice of any kind. Compatibility scores, point totals, and results are entertainment features with no diagnostic or predictive validity. If you are experiencing difficulty in a relationship, please consult a qualified professional.

3.5 Content may not be to your taste

The App's content is randomized. You may encounter prompts you find awkward, uncomfortable, or objectionable, particularly at higher spice levels. Lower the spice level or stop using the App if the content is not right for you. You can tell us what missed at support@amunstudios.com.

4. Your Content

Any text you enter into the App — player names, answers, custom entries — is stored locally on your device only. It is not transmitted to us, and we never see it. You retain any rights you have in what you write.

Because your content never reaches us, we do not moderate it and take no responsibility for it. You are responsible for what you type and for who can see your device.

5. Advertising

Cahoots is provided free of charge and is supported by advertising delivered through Google AdMob.

By using the App, you agree to the display of advertisements. Advertisements are selected and served by Google and its partners, not by Amun Studios. We do not endorse, verify, or take responsibility for the content of any advertisement, or for any product, service, or website reached through one. Any dealing you have with an advertiser is solely between you and that advertiser.

Attempting to block, spoof, or artificially interact with advertising in the App is a violation of these Terms.

Your privacy in relation to advertising is described in our Privacy Policy.

6. Intellectual Property

The App and all of its contents — including the Cahoots name, logo, game mode names, prompt library, written content, visual design, artwork, and software — are owned by Amun Studios LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

These Terms grant you a license to use the App. They transfer no ownership. All rights not expressly granted are reserved.

7. Availability and Changes

We may modify, suspend, update, or discontinue the App or any of its features at any time, with or without notice. We may add, remove, or revise game modes and prompt content. We are not liable to you for any modification, suspension, or discontinuation of the App.

We do not guarantee that the App will be available, uninterrupted, or free of errors.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP — INCLUDING ANY HARM ARISING FROM CONTENT DISPLAYED BY THE APP OR ACTIONS TAKEN IN RESPONSE TO IT — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE UNITED STATES DOLLARS ($25.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.

10. Indemnification

You agree to indemnify, defend, and hold harmless Amun Studios LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) your use or misuse of the App, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) any action you or another player takes in response to App content.

11. Termination

These Terms remain in effect while you use the App. You may terminate them at any time by uninstalling the App and ceasing all use.

We may terminate or suspend your license immediately, without notice, if you breach these Terms. Sections 3, 4, 6, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.

Informal resolution first. If you have a dispute with us, please contact us at support@amunstudios.com and describe the problem. We will try in good faith to resolve it informally. Most issues can be settled this way, and we ask that you give us 30 days to do so before starting formal proceedings.

If a dispute cannot be resolved informally, you and Amun Studios agree that it shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings in your local courts or the protection of mandatory local consumer law, nothing in this section removes that right.

13. Apple and Google

The following applies where you obtained the App from a platform store:

  • These Terms are between you and Amun Studios LLC only, not with Apple Inc. or Google LLC. Amun Studios, not Apple or Google, is solely responsible for the App and its content.

  • Apple and Google have no obligation to provide maintenance or support for the App.

  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund your purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

  • Amun Studios, not Apple or Google, is responsible for addressing any claim relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or privacy law.

  • Amun Studios, not Apple or Google, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes intellectual property rights.

  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

  • Apple Inc. and Google LLC and their subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

You must also comply with any applicable third-party terms of service when using the App, including your platform store's terms of service.

14. General

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amun Studios regarding the App and supersede any prior agreements.

Severability. If any provision is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.

Changes to these Terms. We may revise these Terms from time to time. The "Last updated" date will change, and material revisions will be noted in the App's release notes. Continued use of the App after revised Terms take effect constitutes acceptance. If you do not agree, stop using the App and uninstall it.
