Terms of Service for Elite Habits

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you ("you" or "user") and Amun Studios LLC ("we," "us," or "our"), governing your use of the Elite Habits mobile application ("the App"). By downloading, installing, or using Elite Habits, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of the App

Elite Habits is a habit-tracking application that allows you to create, track, and manage personal habits and routines. All data you create within the App — including habits, progress, streaks, notes, and settings — is stored locally on your device. The App does not require an account, does not connect your data to any cloud service, and does not collect any personal information. See our [Privacy Policy] for full details.

3. Eligibility

You may use Elite Habits regardless of age, as the App does not collect personal data. If you are a minor, you should have a parent or guardian review these Terms and the App before use, in accordance with the requirements of your jurisdiction.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Elite Habits on devices that you own or control, solely for your personal, non-commercial use.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App

  • Reverse engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation

  • Remove, alter, or obscure any proprietary notices on the App

5. Your Content and Data

All content you create within Elite Habits (habits, notes, logs, and similar data) belongs to you. Because this data is stored only on your device:

  • We have no access to it and cannot view, back up, retrieve, or restore it

  • You are solely responsible for safeguarding it, including through your device's own backup features

  • If you uninstall the App, switch devices, or your device is lost, damaged, or reset, any data within the App may be permanently lost, and we are not responsible for that loss

6. Intellectual Property

The App, including its design, graphics, logos, icons, text, and underlying code, is owned by Amun Studios LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you. "Elite Habits" and associated logos are trademarks of Amun Studios LLC.

7. Updates to the App

We may release updates, patches, or new versions of Elite Habits from time to time to add features, improve performance, or fix issues. We are not obligated to provide updates or to maintain compatibility with any particular device or operating system version indefinitely.

8. Third-Party Platforms

Elite Habits is distributed through third-party app marketplaces (such as the Apple App Store or Google Play Store). Your download and use of the App may also be subject to those platforms' own terms of service. We are not responsible for the policies or practices of those platforms.

9. Disclaimer of Warranties

ELITE HABITS IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA STORED WITHIN THE APP WILL NOT BE LOST OR CORRUPTED.

Elite Habits is intended as a personal productivity and habit-tracking tool. It is not a substitute for professional medical, psychological, or therapeutic advice. If you are using the App to track habits related to health, mental health, or wellbeing, you should consult an appropriate professional as needed; the App is not designed to diagnose, treat, or manage any medical or psychological condition.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO DOWNLOAD OR USE THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App at any time by uninstalling it. Because the App stores no data on our end, termination has no effect on any locally stored data on your device — that data remains with you, subject to Section 5 above.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
