Terms of Service for Orbit Xpress

These Terms of Service ("Terms") govern your access to and use of the mobile application Orbit Xpress (the "App"), published by Amun Studios LLC ("Amun Studios," "we," "us," or "our").

Please read these Terms carefully. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download, install, or use the App.

1. Eligibility

Orbit Xpress is intended for users 13 years of age or older. By using the App, you represent and warrant that you are at least 13 years old.

If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to restrict or terminate access if we learn that a user does not meet the minimum age requirement.

2. License to Use the App

Subject to your compliance with these Terms, Amun Studios grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a device that you own or control, solely for your personal, non-commercial entertainment purposes.

This license does not transfer ownership of anything to you. All rights not expressly granted are reserved by Amun Studios.

3. Restrictions on Use

You agree that you will not, and will not permit any third party to:

  • Copy, modify, adapt, translate, or create derivative works based on the App

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent such restriction is prohibited by applicable law

  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices

  • Rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the App

  • Use cheats, automation software, bots, mods, hacks, memory editors, or any unauthorized third-party software to modify or interfere with gameplay

  • Interfere with, disrupt, or attempt to gain unauthorized access to the App or any systems or networks connected to it

  • Use the App in any manner that violates applicable law or regulation

  • Use the App to develop a competing product or service

4. Advertising

The App is provided free of charge and is supported by third-party advertising delivered through Google AdMob.

By using the App, you acknowledge and agree that advertisements will be displayed, and that our advertising partners may collect device and usage information as described in our Privacy Policy. We do not control the specific content of advertisements shown, and the appearance of an advertisement does not constitute an endorsement by Amun Studios of the advertised product, service, or advertiser.

Any dealings you have with advertisers — including purchases, downloads, or participation in promotions — are solely between you and that advertiser. Amun Studios is not responsible or liable for any loss or damage arising from such dealings.

5. Game Data and Progress

Game progress, high scores, and settings are stored locally on your device. Amun Studios does not maintain servers that store your game data and cannot recover, restore, or transfer your progress.

You acknowledge that your game data may be lost if you uninstall the App, reset your device, switch to a new device, clear app storage, or if data becomes corrupted. Amun Studios is not liable for the loss of game data under any circumstances.

6. Intellectual Property

The App and all of its contents — including but not limited to the name "Orbit Xpress," the Amun Studios name and logo, source code, artwork, graphics, animations, characters, level designs, user interface, music, sound effects, and text — are the property of Amun Studios LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use any Amun Studios trademark, trade name, or logo without our prior written permission.

7. Third-Party Services

The App incorporates third-party services, including Google AdMob and the app distribution platform through which you obtained the App (the Apple App Store or Google Play Store). Your use of those services is governed by their respective terms and privacy policies. Amun Studios is not responsible for the availability, accuracy, content, or practices of any third-party service.

8. Updates and Availability

We may from time to time release updates, patches, bug fixes, or new versions of the App. Depending on your device settings, these may install automatically. Some updates may be required for continued use of the App.

We reserve the right at any time, and without liability to you, to modify, suspend, or discontinue the App or any feature of it, in whole or in part, with or without notice. We do not guarantee that the App will be available at all times or in all jurisdictions.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMUN STUDIOS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR DEVICE DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED FIFTY UNITED STATES DOLLARS (US $50.00) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Amun Studios LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Health and Safety Notice

A small percentage of people may experience seizures or blackouts triggered by flashing lights or patterns, including while playing video games. If you experience dizziness, altered vision, eye or muscle twitching, disorientation, or convulsions while playing, stop immediately and consult a physician.

To reduce the risk of eye strain and repetitive motion injury, take regular breaks, play in a well-lit room, and avoid playing when tired.

13. Termination

These Terms remain in effect until terminated. Your license terminates automatically and immediately, without notice, if you fail to comply with any provision of these Terms.

You may terminate these Terms at any time by uninstalling the App and ceasing all use of it.

Sections 3, 6, 9, 10, 11, 14, and 15 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

You agree that any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Union, United Kingdom, or another jurisdiction whose law grants you the right to bring claims in your local courts or under your local law, nothing in this section deprives you of that right.

15. Apple App Store Additional Terms

The following applies if you obtained the App from the Apple App Store:

  • These Terms are between you and Amun Studios LLC only, not with Apple Inc. ("Apple"). Amun Studios, not Apple, is solely responsible for the App and its content.

  • Your use of the App must comply with the Apple Media Services Terms of Use.

  • Apple has no obligation to furnish any maintenance or support services with respect to the App.

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.

  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims of failure to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights.

  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

16. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amun Studios regarding the App and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or any rights under them. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Changes to These Terms. We may modify these Terms at any time. When we do, we will update the "Last Updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it.
