Terms of Service — Paddle Out: Block Escape

These Terms of Service (the "Terms") form a binding agreement between you and Amun Studios LLC, a California limited liability company ("Amun Studios," "we," "us," or "our"), governing your use of the mobile application Paddle Out: Block Escape, including all updates, content, and related services (collectively, the "App").

Please read these Terms carefully. By downloading, installing, or using the App, you agree to be bound by them. If you do not agree, do not use the App and delete it from your device.

1. Eligibility

The App is intended for users aged 13 and older. By using the App, you represent that you are at least 13 years of age. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you are under 13, you may not use the App.

2. License Grant

Subject to your compliance with these Terms, Amun Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial entertainment.

This is a license, not a sale. Amun Studios and its licensors retain all right, title, and interest in and to the App.

3. Restrictions

You agree that you will not, and will not permit others to:

  • Copy, modify, adapt, translate, or create derivative works of the App

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the limited extent this restriction is prohibited by applicable law

  • Rent, lease, lend, sell, sublicense, distribute, or commercially exploit the App

  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices

  • Use cheats, bots, automation software, memory editors, modified clients, or any other method to interfere with the intended operation of the App

  • Interfere with, block, spoof, or artificially inflate the display or interaction of advertisements, or otherwise engage in click fraud

  • Use the App in violation of any applicable law or regulation, or in any manner that could damage, disable, overburden, or impair the App or any third-party service it relies on

  • Access the App through any means other than the official Apple App Store or Google Play distribution channels

4. Advertising

The App is provided free of charge and is supported by advertisements served through Google AdMob. By using the App, you acknowledge and agree that advertisements will be displayed, including banner, interstitial, and optional rewarded ad formats.

Advertisements are supplied by third parties. Amun Studios does not create, endorse, verify, or take responsibility for the content of any advertisement, or for any product, service, offer, or website reached through an advertisement. Any dealings you have with an advertiser are solely between you and that advertiser.

Information collected in connection with advertising is described in our Privacy Policy, which is incorporated into these Terms by reference.

Attempting to circumvent, block, or manipulate advertising within the App is a material breach of these Terms.

5. Game Content and Progress

All game data — including level progress, statistics, and settings — is stored locally on your device. Amun Studios does not operate servers for the App and does not back up, sync, restore, or otherwise maintain a copy of your progress.

You are solely responsible for your data. Progress may be permanently lost if you uninstall the App, clear its data, reset your device, switch devices, or experience device failure. Amun Studios has no ability to recover lost progress and will not be liable for any such loss.

6. Purchases

The App contains no in-app purchases at the time of publication. Should optional purchases (for example, an ad-free upgrade) be introduced in a future version, they will be processed exclusively by Apple or Google through their respective platforms, subject to those platforms' terms and refund policies. Amun Studios does not process payments and cannot issue refunds directly; all refund requests must be directed to Apple or Google.

7. Updates and Availability

We may release updates, patches, bug fixes, or new content for the App at our discretion. Depending on your device settings, updates may install automatically. Some updates may be required for continued use of the App.

We may modify, suspend, or discontinue the App — in whole or in part, temporarily or permanently — at any time and without notice or liability to you. We do not guarantee that the App will be available, uninterrupted, error-free, or compatible with any particular device or operating system version.

8. Intellectual Property

The App, including its source code, artwork, characters, level designs, music, sound effects, user interface, text, and the names, logos, and marks "Amun Studios" and "Paddle Out: Block Escape," are the property of Amun Studios LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use any Amun Studios trademark without our prior written permission.

9. Feedback

If you send us suggestions, ideas, bug reports, or other feedback about the App, you grant Amun Studios a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, and exploit that feedback for any purpose without obligation, attribution, or compensation to you. Please do not send us confidential information.

10. Third-Party Services

The App incorporates third-party software and services, including Google AdMob and platform services provided by Apple and Google. Your use of the App may be subject to the terms and policies of those third parties. Amun Studios is not responsible for the acts, omissions, availability, or content of any third-party service.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum duration and scope permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMUN STUDIOS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GAME PROGRESS, GOODWILL, OR DEVICE FUNCTIONALITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO AMUN STUDIOS FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS (US $25.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless Amun Studios LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Termination

These Terms remain in effect until terminated. You may terminate them at any time by deleting the App from all of your devices.

We may suspend or terminate your license immediately, without notice, if you breach these Terms. Upon termination, you must cease all use of the App and delete it. Sections 5, 8, 9, and 11 through 17 survive termination.

15. Apple-Specific Terms

The following applies if you obtained the App from the Apple App Store:

  • These Terms are between you and Amun Studios only, not with Apple. Apple is not responsible for the App or its content.

  • Apple has no obligation to furnish any maintenance or support services for the App.

  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.

  • Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims of legal or regulatory non-compliance, or consumer protection claims.

  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights.

  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before filing any claim, you agree to contact us at info@amun-studios.com and attempt to resolve the dispute informally for at least thirty (30) days. Most issues can be settled this way.

Venue. If informal resolution fails, you and Amun Studios agree that any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. Either party may bring an individual action in small claims court where jurisdiction and venue requirements are met.

Nothing in this section limits any non-waivable rights you may have under the mandatory consumer protection laws of your country of residence.

17. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Amun Studios regarding the App and supersede all prior understandings.

Severability. If any provision is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.

No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms. We may assign them freely in connection with a merger, acquisition, or sale of assets.

Changes to These Terms. We may revise these Terms from time to time. The "Last Updated" date will reflect any revision, and material changes will be noticed in the App where reasonably practicable. Continued use of the App after changes take effect constitutes acceptance.
