Terms of Service — Ruckus: Pass the Phone

These Terms of Service ("Terms") form a binding agreement between you and Amun Studios LLC, a limited liability company organized under the laws of the State of California ("Amun Studios," "we," "us," or "our"), governing your use of the mobile application Ruckus: Pass the Phone (the "App").
By downloading, installing, or using the App, you accept these Terms. If you do not accept them, do not use the App.
1. Eligibility
The App is intended for users 18 years of age or older. By using the App you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the App in a jurisdiction where the age of majority is higher than 18, you must meet that higher age.
The App contains mature content, including profanity, crude humor, and sexual references, particularly in its "Spicy" and "Filthy" content tiers. Do not use the App if such content is unlawful where you are located or if you are under the required age.
2. License
Subject to your compliance with these Terms, Amun Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on a device you own or control, solely for your personal, non-commercial entertainment.
This is a license, not a sale. All rights not expressly granted are reserved.
3. Restrictions
You agree not to:
a. Copy, modify, adapt, translate, or create derivative works of the App; b. Reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law; c. Rent, lease, lend, sell, sublicense, or otherwise commercially exploit the App; d. Remove, obscure, or alter any copyright, trademark, or proprietary notice; e. Use the App for any unlawful purpose or in violation of any applicable law; f. Interfere with, disrupt, or circumvent any security feature, advertising mechanism, or usage limitation of the App; g. Use automated means, including bots or scripts, to interact with the App or to generate artificial advertising impressions or clicks; h. Use the App to harass, threaten, defame, or harm any person.
4. Content and Gameplay
4.1 Nature of the Content
The App presents prompts, questions, and challenges intended as comedic entertainment for consenting adults playing together in person. Prompts in the Spicy and Filthy tiers are deliberately provocative and may address sexual topics, embarrassing personal history, and other sensitive subjects.
Prompts are fiction written for comedic effect. They are not advice, encouragement, instruction, or endorsement of any behavior. You are solely responsible for what you say and do while playing.
4.2 Your Content
Names, answers, and text you enter during gameplay ("Your Content") are stored locally on your device and are never transmitted to Amun Studios. We do not collect, review, moderate, or retain Your Content, and we claim no ownership of it. You are solely responsible for Your Content and for anything you disclose to other players.
4.3 Play Responsibly
You control who plays, which content tier is selected, and whether to answer, skip, or stop. You agree to obtain the consent of everyone participating, to respect anyone who declines a prompt, and to select a content tier appropriate to your group. Do not use this App with anyone under 18.
4.4 No Encouragement of Substance Use
The App is not a drinking game and does not require or reward the consumption of alcohol or any other substance. Any decision to consume alcohol during play is entirely your own, is undertaken at your own risk, and must comply with applicable law. Never drink and drive.
5. Advertising
The App is provided free of charge and is supported by third-party advertising delivered through Google AdMob. By using the App you agree to the display of advertisements.
We do not select, control, endorse, or verify the content of the ads displayed. Your interactions with advertisers, including any purchase or correspondence, are solely between you and the advertiser. Amun Studios is not responsible for any loss or damage arising from those interactions.
Attempting to block, spoof, or artificially inflate advertising within the App is a material breach of these Terms.
The collection of data by our advertising partner is described in our Privacy Policy.
6. Intellectual Property
The App and all of its contents — including the name "Ruckus: Pass the Phone," all prompt and question content, game designs and rules, user interface, graphics, icons, color schemes, sounds, text, and software — are owned by Amun Studios LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
"Amun Studios" and "Ruckus" are trademarks of Amun Studios LLC. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.
7. Third-Party Services
The App interoperates with third-party services, including Google AdMob and the app store from which you obtained it. Your use of those services is governed by their own terms and privacy policies. Amun Studios is not responsible for the availability, accuracy, content, or practices of any third-party service.
8. Availability, Updates, and Discontinuation
We may modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice, and without liability to you. We are not obligated to provide support, maintenance, updates, or new content. Updates may be required for continued use.
Your device may need to meet certain operating system or hardware requirements, which may change over time.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
To the maximum extent permitted by law, Amun Studios disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that the App will meet your requirements or produce any particular result.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMUN STUDIOS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, REPUTATION, OR RELATIONSHIPS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Without limiting the foregoing, we are not liable for any embarrassment, offense, emotional distress, interpersonal conflict, damage to reputation, or personal injury resulting from prompts presented by the App or from statements made by players during gameplay.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence, where such limitation is prohibited by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Amun Studios LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your use of the App, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, or (d) statements you or your fellow players make during gameplay.
12. Termination
These Terms remain in effect until terminated. Your license terminates automatically if you breach any provision. You may terminate at any time by deleting the App from your device. Sections 6, 9, 10, 11, 13, and 14 survive termination.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13.2 Informal Resolution
Before initiating any formal proceeding, you agree to contact us at info@amun-studios.com and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.
13.3 Binding Arbitration
If the dispute is not resolved informally, you and Amun Studios agree that any dispute arising out of or relating to these Terms or the App shall be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration shall take place in Los Angeles County, California, or by videoconference at your election. Judgment on the award may be entered in any court of competent jurisdiction.
13.4 Class Action Waiver
YOU AND AMUN STUDIOS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13.5 Exceptions
Either party may bring an individual claim in small claims court, or seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.
13.6 Opt-Out
You may opt out of Sections 13.3 and 13.4 by sending written notice to info@amun-studios.com within thirty (30) days of first using the App, stating your intent to opt out. Opting out does not affect any other provision of these Terms.
13.7 Residents Outside the United States
If you reside in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer protection laws prohibit the above, Sections 13.1 through 13.6 apply only to the extent permitted by law, and you retain the right to bring proceedings in the courts of your country of residence.
14. Apple App Store Additional Terms
The following applies if you obtained the App from the Apple App Store:
a. These Terms are between you and Amun Studios LLC only, not Apple Inc. ("Apple"). b. Apple has no obligation to provide any maintenance or support for the App. c. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. d. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims of legal or regulatory non-compliance, and consumer protection claims. e. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights. f. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. g. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
15. Google Play Additional Terms
If you obtained the App from Google Play, your use is additionally subject to the Google Play Terms of Service. Google is not a party to these Terms and bears no responsibility for the App.
16. General
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Amun Studios regarding the App and supersede all prior agreements.
Severability. If any provision is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them freely, including in connection with a merger, acquisition, or sale of assets.
Changes. We may revise these Terms at any time. The "Last Updated" date will be revised, and material changes will be communicated through the App or store listing. Continued use after changes take effect constitutes acceptance.
