Terms of Service — Tideguard: Match

These Terms of Service ("Terms") form a binding agreement between you and Amun Studios LLC, a California limited liability company ("Amun Studios," "we," "us," or "our"), governing your access to and use of the mobile application Tideguard: Match (the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App.

1. Eligibility

The App is intended for users 13 years of age or older. By using the App, you represent that you are at least 13 years old.

If you are between 13 and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents and guardians are responsible for their minor children's use of the App.

The App is not directed to children under 13 and is not offered in Apple's Kids Category or Google Play's Designed for Families program.

2. License Grant

Subject to your compliance with these Terms, Amun Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

This is a license, not a sale. Amun Studios and its licensors retain all right, title, and interest in and to the App.

3. Restrictions

You agree that you will not, and will not permit any third party to:

Copy, modify, adapt, translate, or create derivative works of the App
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent such restriction is expressly prohibited by applicable law
Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party
Remove, obscure, or alter any copyright, trademark, or other proprietary notices
Use cheats, automation software, bots, mods, hacks, memory editors, or any unauthorized third-party software designed to modify or interfere with the App
Circumvent, disable, block, or interfere with the display of advertisements, or with any security, technical, or usage-measurement feature of the App
Use the App for any unlawful purpose or in violation of any applicable law or regulation
Attempt to gain unauthorized access to any system, network, or data connected to the App
Use the App in any manner that could disable, overburden, damage, or impair it

4. Advertising

The App is provided free of charge and is supported by third-party advertising, currently delivered through Google AdMob.

By using the App, you acknowledge and agree that:

Advertisements will be displayed during your use of the App, including banner and full-screen interstitial formats
Advertisements are provided by third parties over whose content Amun Studios exercises no editorial control
Amun Studios does not endorse, and is not responsible for, any product, service, representation, or claim made in any advertisement, nor for any transaction you enter into with an advertiser
Interacting with an advertisement may direct you to a third-party website or application governed by that party's own terms and privacy policy
Advertising may involve the collection of device and advertising identifiers by the ad provider, as described in our Privacy Policy

Where required by law, the App will present a consent interface before serving personalized advertisements. You may adjust or withdraw consent, and may limit ad personalization through your device's operating system settings. Doing so does not remove advertising from the App.

Attempting to block, spoof, or otherwise interfere with ad delivery is a material breach of these Terms.

5. No In-App Purchases

The App does not currently offer in-app purchases, subscriptions, virtual currency, or any other paid content. Amun Studios reserves the right to introduce optional paid features in a future version, in which case applicable purchase terms will be presented to you before any transaction and all purchases will be processed by the Apple App Store or Google Play under their respective terms.

6. Game Data and Progress

All game progress, high scores, and settings are stored locally on your device. Amun Studios does not operate a server for the App, does not maintain cloud saves, and has no ability to view, recover, restore, or transfer your progress.

You are solely responsible for your game data. Progress may be permanently lost if you uninstall the App, reset your device, switch devices, clear application storage, or experience device failure or data corruption. Amun Studios is not liable for any loss of game data or progress under any circumstances.

7. Intellectual Property

The App, including its source code, artwork, characters (including the character "Pip"), level designs, user interface, audio, music, sound effects, text, and the names "Tideguard: Match" and "Amun Studios," together with all associated logos and marks, are the property of Amun Studios LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers any ownership interest to you. All rights not expressly granted are reserved.

You may capture and share screenshots and video recordings of your own gameplay for personal, non-commercial purposes, including on streaming and social media platforms, provided you do not imply endorsement or affiliation by Amun Studios.

8. Updates and Availability

Amun Studios may, at its sole discretion and without notice, release updates, patches, or new versions of the App; modify, suspend, or discontinue any feature; or discontinue the App entirely.

Certain updates may be required for continued use. Your device platform may install updates automatically depending on your settings. Amun Studios does not guarantee that the App will remain available, remain compatible with any particular device or operating system version, or continue to be offered in any particular territory.

9. Third-Party Services and Platforms

The App relies on services provided by third parties, including Google (AdMob) and the platform through which you obtained the App (Apple App Store or Google Play). Your use of those services is governed by the third party's own terms and privacy policies. Amun Studios is not responsible for the acts, omissions, availability, or content of any third-party service.

Apple-specific terms

If you obtained the App from the Apple App Store, you acknowledge that: these Terms are between you and Amun Studios only, not Apple; Apple has no obligation to provide maintenance or support for the App; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation whatsoever; Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, legal or regulatory non-compliance, or consumer protection claims; Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the App; you comply with all applicable third-party terms in using the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand what information is and is not collected.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMUN STUDIOS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

AMUN STUDIOS DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL OPERATE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT IT IS FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such cases, any implied warranty is limited to the shortest duration permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMUN STUDIOS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GAME PROGRESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT AMUN STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL AMUN STUDIOS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO AMUN STUDIOS FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS ($25.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Amun Studios LLC and its members, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

14. Termination

These Terms remain in effect until terminated.

Amun Studios may terminate or suspend your license to use the App immediately and without notice if you breach any provision of these Terms. You may terminate at any time by ceasing all use of the App and deleting it from your devices.

Upon termination, the license granted in Section 2 ends and you must delete all copies of the App. Sections 6, 7, and 11 through 18 survive any termination.

15. Governing Law

These Terms and any dispute arising out of or relating to them or the App are governed by the laws of the State of California, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you reside in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer protection laws would otherwise apply, nothing in this Section deprives you of the protection of those mandatory provisions or of your right to bring proceedings in your country of residence.

16. Dispute Resolution

Informal resolution first. Before initiating any formal proceeding, you agree to contact us at info@amun-studios.com with a description of the dispute and to attempt in good faith to resolve it informally for a period of at least thirty (30) days.

Venue. Subject to the informal resolution requirement above and to any mandatory consumer protections that apply to you, you and Amun Studios agree that any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

Small claims. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

Class action waiver. To the fullest extent permitted by law, you and Amun Studios agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

17. Changes to These Terms

Amun Studios may revise these Terms from time to time. When we do, we will update the "Last Updated" date above and, for material changes, provide notice through the App or its store listing.

Your continued use of the App after revised Terms take effect constitutes acceptance of the revisions. If you do not agree to the revised Terms, you must stop using the App and delete it.

18. General Provisions

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Amun Studios regarding the App and supersede all prior agreements and understandings on that subject.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

No waiver. Amun Studios' failure to enforce any provision is not a waiver of its right to do so later.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. Amun Studios may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

Force majeure. Amun Studios is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control.

Headings. Section headings are for convenience only and have no legal effect.
