xEV Terms of Service

These Terms of Service ("Terms") govern your use of the xEV mobile application (the "App"), provided by xEV ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

This document is a template provided for general guidance and is not a substitute for legal advice. We recommend having it reviewed by a qualified attorney before publishing, and adapting it to the app stores' specific terms (Apple App Store / Google Play) and any regions you operate in.

1. The Service

xEV helps users locate electric vehicle (EV) charging stations on a map, filter stations by connector type (e.g., NACS, CCS, CHAdeMO, AC) and charging speed, and search by address or city. The App may display advertising served by Google AdMob.

2. Accuracy of Charging Station Information

Charging station locations, connector types, power ratings, availability, and pricing shown in the App may be sourced from third parties or public data and are provided for informational purposes only. Station data can be outdated, incomplete, or incorrect, and stations may be offline, in use, or removed without notice. We do not guarantee the accuracy, completeness, or availability of any charging station information. Always verify station status and compatibility with the charging network operator before relying on it, especially for trip planning.

3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial use. You may not:

  • Copy, modify, reverse-engineer, or create derivative works of the App;

  • Use the App for any unlawful purpose or in a way that could damage, disable, or impair the App or interfere with other users;

  • Scrape, harvest, or resell data from the App;

  • Circumvent any access or security measures.

4. Location Services

The App requests access to your device's location to show nearby charging stations. Granting location access is optional — you can decline it and instead search by address or city. You are responsible for managing this permission in your device settings.

5. Advertising

The App displays ads through Google AdMob. Ads are provided by third parties, and we do not control or endorse the content of third-party ads. Your interaction with ads is subject to Google's terms and privacy practices (see our Privacy Policy).

6. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for complying with all traffic, parking, and charging-network rules while using information from the App in the real world.

7. Intellectual Property

The App, including its design, logos, and content (excluding third-party data and ads), is owned by xEV or its licensors and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CHARGING STATION DATA WILL BE ACCURATE OR CURRENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, xEV AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING RELIANCE ON CHARGING STATION INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT (IF ANY) YOU PAID TO US FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Third-Party Services and Links

The App may rely on or link to third-party services (e.g., mapping providers, charging network websites, Google AdMob). We are not responsible for the content, accuracy, or practices of third parties, and your use of third-party services is governed by their own terms.

11. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms. You may stop using the App and uninstall it at any time.

12. Changes to the App or These Terms

We may modify, suspend, or discontinue the App, or update these Terms, at any time. Material changes to these Terms will be reflected by updating the "Effective Date" above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws of your country or state of residence apply.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and xEV regarding the App.
