Terms of Service for xSobriety

These Terms of Service ("Terms") are a legal agreement between you and Amun Studios LLC ("Amun Studios," "we," "us," or "our") governing your use of the xSobriety mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
The App relates to alcohol use and is intended for adults. You must be at least 21 years old (or the legal drinking age in your jurisdiction, if higher) to use the App. By using the App, you represent that you meet this requirement.
2. License to use the App
Subject to these Terms, Amun Studios grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.
You may not: (a) copy, modify, distribute, sell, or lease any part of the App; (b) reverse engineer or attempt to extract the source code, except where such restriction is prohibited by law; (c) use the App in any unlawful manner or in violation of these Terms; or (d) interfere with or disrupt the App or its advertising.
3. Not medical advice — important
xSobriety is a habit-tracking and motivation tool. It is not a medical device and does not provide medical, clinical, psychological, or professional advice, diagnosis, or treatment. The App's content, statistics, timelines, and features (including any information about alcohol, cravings, calories, "recovery" milestones, or health) are for general informational and motivational purposes only.
Do not rely on the App as a substitute for advice from a qualified healthcare professional.
Alcohol withdrawal can be dangerous or life-threatening. If you drink heavily or frequently, consult a healthcare professional before reducing or stopping, and do not use the App as a medical guide.
The support resources listed in the App (such as helplines and mutual-aid organizations) are provided for convenience; we do not operate, endorse, or take responsibility for them.
If you are experiencing a medical or mental-health emergency, call your local emergency number immediately.
Your decisions about alcohol and your health are your own responsibility.
4. User data
You are solely responsible for the information you enter into the App. As described in our Privacy Policy, this data is stored locally on your device and is not backed up by us. If you uninstall the App, reset your device, or clear the App's data, that information may be permanently lost. We are not responsible for any loss of data, and we cannot recover it for you. You are responsible for maintaining your own backups if desired.
5. Advertising and third-party services
The App is supported by banner advertisements served through Google AdMob. By using the App, you acknowledge that Google and its partners may collect and use certain device and usage information to deliver ads, as described in our Privacy Policy and in Google's own policies. Advertisements may link to third-party websites or products that we do not control and are not responsible for. Your interactions with advertisers are solely between you and the advertiser.
6. Intellectual property
The App, including its design, text, graphics, logos, the "xSobriety" name, and all related content (excluding your own entries and third-party ad content), is owned by Amun Studios or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY INFORMATION IT PROVIDES IS ACCURATE, COMPLETE, OR RELIABLE. YOU USE THE APP AT YOUR OWN RISK.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMUN STUDIOS LLC AND ITS OWNERS, MEMBERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIVE U.S. DOLLARS (US$5.00).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Amun Studios LLC and its owners, members, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
10. Termination
You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App, in whole or in part, at any time. The provisions of these Terms that by their nature should survive termination (including Sections 3, 4, and 6–9) will survive.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in California, United States, and you consent to personal jurisdiction there.
Before filing any claim, you agree to first contact us at info@amun-studios.com and attempt in good faith to resolve the dispute informally.
12. Changes to these Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Apple and Google app store terms
If you downloaded the App from the Apple App Store or Google Play, you also agree to that store's applicable terms. You acknowledge that these Terms are between you and Amun Studios only, and not with Apple or Google, and that Apple and Google are not responsible for the App or its support. Where required, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
